BMW Levis and D2C Media´s Privacy Policy applies to all of the services offered by BMW Levis and D2C Media and/or its affiliated companies. 5.0 Retention & Disposal Practices
Our dealership will retain your personal information for only as long as necessary for the respective purpose(s) for which it was collected and for a longer period only as required for compliance with applicable law, our contractual obligations, or defending or pursuing legal proceedings. To comply with contractual obligations, personal information acquired from you can be kept for as long as the contract is in force and - depending on the nature and scope of the contract - for 6 or 10 years beyond this point in order to comply with legal requirements for record keeping and to ensure clarification of any queries or claims after the end of the contract. Personal information that in our opinion will be necessary to assess and avert claims against us or to initiate criminal proceedings or assert claims against you, us or third parties can be kept by us for as long as corresponding proceedings could be initiated. For customer care, personal information acquired from you can be kept for 3 to 10 years depending upon the specific purpose, unless you wish to have this information deleted or destroyed and there are no contractual or legal requirements for preservation that prevent this request for deletion or destruction. Personal information that is no longer required in accordance with the above statements will be destroyed, erased or made anonymous. Our dealership will take reasonable physical, electronic and managerial measures to protect personal information and to ensure that the handling, disposal or destruction of personal information is done in such a way as to prevent unauthorized parties from gaining access to the information.
6.0 Sensitive Personal Information
When you sign up for a particular service that requires registration, we may ask you to provide Sensitive Personal information. We will not collect or use Sensitive Personal information (which includes information we know to be related to confidential medical information, racial or ethnic origins, political or religious beliefs or sexuality and tied to personal information) for purposes other than those described in this Policy and/or in the specific service notices, unless we have obtained your prior consent.
You can decline to submit Sensitive Personal information to any of our services, in which case BMW Levis and D2C Media may not be able to provide those services to you.

This Agreement will be governed and interpreted in accordance with the laws in effect in Canada and in the province of Quebec and the competent courts of Montreal will have exclusive jurisdiction over any proceedings. This Agreement, and any modifications thereof, constitutes the entire agreement between the parties with respect to the subject matter hereof.
